Recent reforms, including specialised commercial courts and pre‑institution mediation, are cutting litigation time and costs, boosting predictability for Indian businesses.

The introduction of specialised commercial courts and a suite of procedural reforms is reshaping the way commercial disputes are resolved in India, offering a faster and more predictable legal environment for businesses.

The Commercial Courts Act, 2015 established dedicated courts to handle commercial matters, reducing the burden on regular civil courts and shortening the duration of litigation. Subsequent amendments have expanded the reach of these courts, ensuring that complex business cases receive focused attention.

A key addition is pre‑institution mediation, which encourages parties to settle disputes before filing a suit. This mechanism lowers litigation costs and eases court congestion. Complementing this, digital court systems have been deployed to streamline filing, case management and hearings.

Collectively, the reforms are lowering procedural friction, improving predictability and strengthening India’s Ease of Doing Business score, thereby creating a more conducive ecosystem for commercial activity.
