Telangana High Court Rules Wife’s Advocate Enrolment Not Proof of Income in Maintenance Claim

Hyderabad, Telangana – In a landmark judgment, the Telangana High Court clarified that a woman's enrolment as an advocate does not automatically establish a level of income sufficient to deny her claim for maintenance. The bench examined a petition where the husband argued that his wife's recent registration with the Bar Council indicated financial independence, seeking to reduce or dismiss the maintenance amount.

The court observed that mere enrolment does not equate to actual earnings, as a newly enrolled advocate may not yet have a steady practice or substantial remuneration. It emphasized that maintenance decisions must be based on concrete evidence of income, not on presumptions derived from professional titles.

Consequently, the court directed the lower trial court to reassess the maintenance claim on the basis of verified financial disclosures, ensuring that the wife's livelihood needs are fairly addressed. The ruling underscores the judiciary's stance that legal profession status alone cannot be a shortcut to evade spousal support obligations.
