The Supreme Court of India has reinstated a compensation claim for the family of a passenger who died in a train incident after the ticket could not be located.
The apex court has ordered that the compensation claim filed by the relatives of a passenger who lost his life in a train incident be restored. The decision came after the railway authorities were unable to produce the passenger's ticket, a point that had previously led to the claim being dismissed.
The family had approached the Supreme Court, arguing that the absence of a ticket should not absolve the railways of liability for the fatal accident. In its judgment, the court held that the failure to locate a ticket does not negate the duty of care owed by the railway operator.
Consequently, the court directed the railway to honour the compensation as prescribed under existing statutes, reinforcing the principle that victims' families are entitled to redress even when documentary evidence is missing.
