The apex court ruled that any stamp duty shortfall must be resolved promptly and that trial courts cannot keep the matter pending for years.

New Delhi — In a landmark judgment, the Supreme Court of India held that deficiencies in stamp duty must be addressed without undue delay. The bench emphasized that the purpose of stamp duty is to ensure the legality of documents, and any shortfall undermines that objective. Accordingly, the court directed that the outstanding amount be recovered and the deficiency rectified immediately.

The court further observed that trial courts cannot allow such fiscal disputes to linger for years, as prolonged pendency defeats the interests of justice and hampers commercial transactions. It instructed lower courts to expedite proceedings related to stamp duty deficiencies and to issue appropriate orders for recovery.

Legal experts noted that the ruling reinforces the principle of prompt tax compliance and is likely to impact a range of pending civil suits where stamp duty issues have been raised. The decision also sends a clear message to litigants and authorities that procedural delays in tax matters will not be tolerated.

The judgment is expected to streamline revenue collection for state governments and reduce the backlog of cases involving stamp duty disputes across the country.
