Supreme Court Bars Insurers from Denying Liability for Foreign Accidents Covered by Valid Permit

The Supreme Court ruled that insurers cannot deny liability for accidents occurring outside India when the vehicle was operating under a valid permit and covered by the policy.

The Supreme Court of India today delivered a landmark judgment stating that insurance companies are barred from denying liability for accidents that occur outside the country, provided the vehicle was operating under a valid permit and the incident is covered by the policy.

In its ruling, the Court emphasized that the policy’s geographical coverage is not limited by the location of the accident, as long as the vehicle had a legitimate permit in force at the time of the incident. The decision clarifies that insurers must honour claims for foreign accidents when the conditions of the policy are met.

The judgment is expected to strengthen consumer protection for policyholders who travel abroad with insured vehicles. It also signals to insurers that they must review their terms and conditions to ensure compliance with the Court’s directive.

Industry observers note that the ruling could prompt insurers to adjust their overseas coverage clauses and may lead to a review of premium structures for international travel.

Policyholders affected by similar disputes can now rely on the Supreme Court’s mandate to seek compensation for foreign accidents covered under their policies.
