Rajasthan HC Grants Four-Month Travel Permit for Son’s Surgery Despite Ongoing Probe

Earlier this week the Rajasthan High Court addressed a petition filed by three individuals who sought permission to travel overseas for their son's critical surgery. The court examined whether the ongoing investigation into the accused could automatically prevent the travel request.

In its judgment, the bench clarified that the mere existence of a pending probe does not constitute a legal ground to restrict a person's right to leave the country. Consequently, the court refused to link the investigation with a travel ban.

The judges granted the petitioners a four‑month permission to stay abroad, sufficient time for the required medical procedure and post‑operative care. The court also directed that the investigation continue unabated while the travel permission remains in effect.

The decision underscores the court's stance that procedural investigations should not unduly impede personal emergencies, while also ensuring that legal scrutiny of the case proceeds independently.
