Punjab & Haryana HC Rules Employees Appointed Before 2004 Eligible for Old Pension Scheme

The Punjab and Haryana High Court has held that staff hired before 2004 qualify for the old pension scheme, even if they were regularised at a later date.

The Punjab and Haryana High Court bench delivered a judgment clarifying pension entitlements for a specific group of government employees. The court ruled that any employee appointed before 2004 remains eligible for the pre‑2004 pension scheme, irrespective of when regularisation took place.

According to the order, the decisive factor for pension eligibility is the date of initial appointment, not the date of subsequent regularisation under later service rules. This interpretation aligns with the pension framework that was in force before the 2004 reforms.

The ruling is expected to affect a large number of civil servants and public‑sector workers who were hired prior to the 2004 changes but were regularised later. Authorities have been instructed to recompute pension benefits for the affected cadre and communicate the revised amounts to the employees.

Legal analysts suggest that the decision could inspire similar petitions in other states, prompting a broader review of pension policies across the country. The court also directed the concerned departments to implement the order within a reasonable timeframe.
