The Jharkhand High Court denied a divorce petition filed by a husband who had allegedly called his wife ‘unchaste’ and rejected their son, citing cruelty.

The Jharkhand High Court, in a recent judgment, dismissed a divorce petition filed by a husband who had previously accused his wife of being ‘unchaste’ and had rejected their son. The petition was brought before the court on grounds of alleged cruelty towards the wife.

During the proceedings, the husband presented evidence of verbal abuse and claims that the wife’s conduct was immoral. He also argued that the couple’s son had been disowned, further supporting his request for dissolution of marriage.

The court, however, found the evidence insufficient to establish the level of cruelty required for a divorce under Indian law. It noted that the husband's statements, while harsh, did not amount to the physical or psychological abuse mandated by the court for a divorce decree.

Consequently, the court denied the divorce petition, allowing the marriage to remain legally intact. The husband has been advised to seek alternative dispute resolution mechanisms for the marital issues.
