The Jharkhand High Court held that when an offence attracts charges under both the POCSO Act and the Indian Penal Code, only the higher punishment prescribed under the POCSO Act should be imposed. The ruling clarifies sentencing principles for overlapping offences involving child sexual abuse.

The judgment came from a bench of the Jharkhand High Court while reviewing a case where the accused was charged under both the POCSO Act and relevant IPC sections for the same act. The court observed that imposing punishment under both statutes would lead to double jeopardy, which is not permissible. It emphasized that the legislature intended the POCSO Act to provide a special, more stringent penal regime for offences against children.

The court therefore directed that, in such overlapping cases, only the higher penalty prescribed by the POCSO Act should be awarded, and the IPC charge should not result in an additional sentence. This approach ensures that the accused receives the stricter punishment without being punished twice for the same conduct.

Legal experts say the ruling brings clarity to trial courts dealing with child sexual abuse cases, reducing confusion over cumulative sentencing. The decision is expected to influence similar proceedings across the country where both POCSO and IPC provisions are invoked.
