The Jharkhand High Court on Tuesday dismissed a divorce petition filed by a husband who alleged that his wife’s habit of applying kajal and lipstick at 2 am was evidence of mental illness. The court held that such late‑night makeup routines do not, in themselves, constitute a medical condition warranting divorce.

In the petition, the husband contended that his wife’s nocturnal beauty routine indicated a deteriorating mental state, which he claimed was a valid ground for dissolution of the marriage. He sought the court’s intervention to terminate the marital bond.

The bench, however, found no medical evidence supporting the claim of mental illness. It emphasized that personal grooming habits, even if performed at unconventional hours, are not sufficient grounds for divorce under the law.

The decision underscores the court’s insistence on concrete medical proof before accepting claims of mental illness as a basis for marital dissolution. It also signals that courts will scrutinize personal habits closely before granting divorce orders.
