The Gujarat High Court refused to grant anticipatory bail to a 70‑year‑old man accused of sexual harassment, saying that his age alone is not enough to warrant such relief. The court stressed that the seriousness of the allegation and the need for a proper investigation outweigh considerations of advanced age.

The Gujarat High Court dismissed an anticipatory bail plea filed by a septuagenarian who is named in an FIR alleging sexual harassment.

The bench observed that while the accused’s age is a relevant factor, it cannot be the sole ground for granting protection from arrest in a case involving serious allegations.

It emphasized that the nature of the offence and the imperative of a fair investigation must be given priority, and therefore declined to extend the benefit of anticipatory bail at this stage.
