Court Dismisses Cruelty FIR Against Mother‑in‑Law Over Prior Marriage Issue

A higher court ruled that a cruelty FIR filed against a mother‑in‑law cannot be sustained because the complainant’s earlier marriage remains subsisting.

The court examined a criminal complaint that alleged cruelty by a mother‑in‑law towards her daughter‑in‑law. During the proceedings, the petitioner’s earlier marriage was found to be still in force, raising a legal impediment to the FIR.

Under Indian law, a cruelty charge under Section 498A of the IPC requires the complainant to be a legally married spouse. The judge held that because the earlier marriage had not been dissolved, the petitioner could not be considered a legitimate spouse of the accused, rendering the FIR untenable.

Consequently, the magistrate ordered the FIR to be dismissed, emphasizing that procedural correctness is essential before invoking criminal provisions in family disputes. The decision underscores the judiciary’s focus on ensuring that criminal statutes are not misapplied in cases where civil marital status remains unresolved.

Legal experts note that the ruling may prompt similar petitions to scrutinize the marital status of complainants before filing cruelty charges, potentially reducing frivolous FIRs in domestic matters.
