Chhattisgarh HC rules non-disclosure of prior marriage not cheating

The division bench of the Chhattisgarh High Court delivered a judgment clarifying that the concealment of an earlier marriage does not satisfy the legal definition of cheating. The ruling arose from a petition in which the petitioner alleged that the respondent’s failure to disclose a prior marriage amounted to criminal cheating.

The court observed that cheating, as defined under the Indian Penal Code, requires a deception that causes a specific loss or injury to the victim. Merely withholding information about a former marriage does not meet this threshold, the bench noted.

While the decision removes the possibility of criminal prosecution for cheating in such cases, the court cautioned that the issue may still have relevance in civil matrimonial disputes, such as divorce or annulment proceedings. Legal experts say the judgment will likely guide lower courts handling similar matrimonial fraud claims across the country.
