The Calcutta High Court ruled that a serving army personnel cannot be compelled to face a fabricated legal case, granting him protection.

Kolkata's Calcutta High Court issued a protective order for a serving army man, stating that the judiciary cannot be used to force a soldier into a false case. The bench emphasized that the integrity of defence personnel must be safeguarded against baseless legal actions.

The court observed that the allegations against the soldier lacked substantive evidence and appeared to be fabricated. Consequently, it directed that the case be dismissed and the soldier be released from any further procedural burden.

Legal experts noted that the ruling reinforces the principle that members of the armed forces should not be subjected to frivolous litigation that could undermine morale and operational readiness. The decision is expected to set a precedent for handling similar claims in the future.
