The Bihar High Court affirmed the earlier sentence and instructed the senior superintendent of police in Darbhanga to initiate departmental disciplinary action against the investigating officer for failing to locate sperm in a medical test, with a report due in three months.

The Bihar High Court upheld the sentence imposed in a sexual assault case, rejecting the claim that the lack of sperm in the victim's medical examination proves the crime did not occur. In its order, the court directed the senior superintendent of police (SP) in Darbhanga to commence a departmental disciplinary inquiry against the officer who performed the forensic test, citing procedural shortcomings. The SP has been given three months to submit a comprehensive report on the disciplinary proceedings to the court. The judgment reinforces the principle that forensic gaps do not automatically exonerate the accused and that police officials must follow established investigative protocols.
